Important: Please read these Terms and Conditions carefully before using Dartmouth Live. By registering an account, submitting an event listing, creating an artist profile, or browsing the platform, you agree to be bound by these terms.

1. About Us and These Terms

Dartmouth Live (dartmouthlive.co.uk) is a community events calendar for Dartmouth, Devon. It is operated by G. Bancroft trading as Arete AI ("we", "us", "our").

These Terms and Conditions ("Terms") govern your use of the Dartmouth Live website and services. They form a legally binding agreement between you and us. If you do not agree to these Terms, you must not use the platform.

We may update these Terms from time to time. If we make material changes, we will notify registered users by email. Your continued use of the platform after changes are published constitutes acceptance of the updated Terms.

2. Eligibility and Account Registration

You must be at least 18 years old to register an account on Dartmouth Live. By registering, you confirm that:

  • You are at least 18 years of age.
  • The information you provide during registration is accurate and complete.
  • You will keep your account details up to date, including your email address and organisation name.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Public viewers do not need an account to browse events. No age restriction applies to browsing.

3. User Types and Access

3.1 Venue Subscribers (Paid)

Local organisations, venues, and event organisers who pay a monthly or annual subscription to list events on Dartmouth Live. Venue Subscribers can:

  • Add, edit, and delete their own events (unlimited).
  • View all events from all venues, enabling clash detection and scheduling decisions.
  • Tag artists performing at their events.
  • Access any additional subscriber features we introduce from time to time.

3.2 Artists (Free)

Performers, musicians, speakers, and other individuals who create a free profile on Dartmouth Live. Artists can:

  • Create and manage their artist profile, including a biography and links.
  • Be tagged by venues on event listings.
  • View all published events.

Artists cannot create event listings themselves. Events are always created by the hosting venue or organisation.

3.3 Public Viewers (Free)

Members of the public who browse events without creating an account. Public Viewers can:

  • Browse all published events by date.
  • Toggle between list view and calendar grid view.
  • Filter events by venue name.

3.4 Admin

The platform administrator (currently G. Bancroft) has full access to manage venue accounts, moderate event listings, approve or reject one-off submissions, and oversee the operation of the platform.

4. Event Listings

4.1 What you can list

Dartmouth Live is for events taking place in or around Dartmouth, Devon. Events must fall within the following categories:

  • Live Music
  • Theatre & Performing Arts
  • Film Screenings
  • Talks & Workshops
  • Festivals

We reserve the right to remove events that fall outside these categories or are not relevant to the Dartmouth community.

4.2 Content standards

All event listings must:

  • Be accurate and not misleading.
  • Relate to a genuine event taking place at a real venue or location.
  • Not contain offensive, discriminatory, or unlawful content.
  • Not infringe the intellectual property rights of any third party.
  • Not be used for advertising or promoting products or services unrelated to the event.

4.3 Moderation

Subscriber events are published immediately upon submission. Paying subscribers are trusted to list events responsibly.

One-off event listings (submitted by non-subscribers who pay a per-event fee) are held in an approval queue and must be approved by the platform administrator before they are published.

We reserve the right to remove, edit, or refuse any event listing at our sole discretion, including subscriber events, if we believe the listing violates these Terms or is otherwise inappropriate.

4.4 Artist tagging

Venue Subscribers may tag artists who are performing at their events. By tagging an artist, you confirm that:

  • The artist is genuinely performing or appearing at the event.
  • You have a reasonable basis for associating the artist with the event.

Artists who believe they have been incorrectly tagged may contact us at hello@dartmouthlive.co.uk to request removal.

4.5 Intellectual property in listings

You retain ownership of all content you submit to Dartmouth Live, including event descriptions and images. By submitting content, you grant us a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that content on the Dartmouth Live platform and in any related marketing materials for the purpose of operating and promoting the service.

5. Pricing and Payment

All payments are processed securely via Stripe. The following plans are available:

5.1 Subscriptions

Monthly and annual subscriptions renew automatically unless cancelled before the end of the current billing period. You can cancel at any time from your account dashboard or by contacting us.

5.2 One-off listings

One-off listing fees are charged at the time of submission. If your listing is rejected by the administrator, we will refund the fee in full.

5.3 Price changes

We may change our prices from time to time. If you are on an active subscription, we will give you at least 30 days' notice before any price increase takes effect. You may cancel your subscription before the new price applies.

5.4 Refunds

Subscription fees are non-refundable except where required by law or where we have materially failed to provide the service. One-off listing fees are refunded if a listing is rejected (see 5.2 above).

5.5 Failed payments

If a subscription payment fails, we will attempt to collect payment again in accordance with Stripe's retry schedule. If payment cannot be collected, your subscription will be marked as past due and may be suspended. Your events will remain on the platform but you will not be able to add new events until payment is resolved.

5.6 Free trial

We do not currently offer a free trial. If we introduce one in the future, the terms will be communicated at the time of sign-up.

6. Artist Profiles

Artist profiles are free to create and maintain. By creating an artist profile, you agree that:

  • The information you provide is accurate and relates to you or the act you represent.
  • Your profile may be displayed publicly on the Dartmouth Live website and linked to event listings where you are tagged as a performer.
  • You are responsible for keeping your profile information up to date.
  • We may remove or suspend artist profiles that contain misleading, offensive, or inappropriate content.

You can delete your artist profile at any time from your account dashboard. Deleting your profile will remove the link between your profile and any events, but the events themselves will remain listed with the venue.

7. Platform Accuracy and Availability

We take reasonable care to ensure that Dartmouth Live is available and that event information is displayed accurately. However:

  • We do not guarantee that the platform will be available at all times. We may carry out maintenance or updates that temporarily affect availability.
  • Event information is provided by venue subscribers and one-off listers. We do not independently verify every listing and cannot guarantee its accuracy.
  • We are not responsible for events being cancelled, rescheduled, or changed by the organiser after they have been listed.

8. Intellectual Property

The Dartmouth Live name, logo, design, and underlying software are owned by G. Bancroft trading as Arete AI. You may not copy, reproduce, or redistribute any part of the platform without our prior written consent, except as permitted by law.

Content submitted by users (event listings, artist profiles, descriptions) remains the intellectual property of the submitting user, subject to the licence granted in section 4.5 above.

9. Acceptable Use

You must not use Dartmouth Live to:

  • Submit false, misleading, or fraudulent event listings.
  • Impersonate another person, venue, or organisation.
  • Upload or distribute viruses, malware, or any other harmful code.
  • Attempt to gain unauthorised access to other users' accounts or to the platform's systems.
  • Scrape, harvest, or extract data from the platform by automated means without our written permission.
  • Use the platform for any purpose that is unlawful or prohibited by these Terms.

We reserve the right to suspend or terminate your account immediately if we believe you have breached this section.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Dartmouth Live is provided on an "as is" and "as available"basis. We make no warranties, express or implied, regarding the platform's suitability for any particular purpose.
  • We are not liable for any indirect, incidental, special, or consequential damages arising from your use of (or inability to use) the platform.
  • Our total liability to you for any claim arising under or in connection with these Terms shall not exceed the total amount you have paid to us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by English law.

11. Data Protection and Privacy

We collect and process personal data in accordance with our Privacy Policy. By using Dartmouth Live, you acknowledge that you have read and understood our Privacy Policy.

In summary, we collect account information (name, email, organisation name) and event data to operate the platform. We do not sell your personal data to third parties. Full details are set out in our Privacy Policy.

12. Third-Party Services

Dartmouth Live uses the following third-party services to operate:

  • Stripe— for payment processing. Your payment details are handled directly by Stripe and are not stored on our servers. Stripe's terms apply to payment transactions.
  • Supabase — for database hosting and authentication.
  • Hostinger — for server hosting.

We are not responsible for the availability, security, or terms of third-party services. However, we select providers with appropriate security and data-protection standards.

13. Complaints

If you have a complaint about the platform, an event listing, or another user, please contact us at hello@dartmouthlive.co.uk. We will acknowledge your complaint within 5 working days and aim to resolve it within 14 working days.

14. Termination

By you: You may cancel your subscription or delete your account at any time. Cancelling a subscription stops future renewals but your access continues until the end of the current billing period. Deleting your account removes your data from the platform, subject to any legal retention requirements.

By us: We may suspend or terminate your account at any time if you breach these Terms, if your payment fails and cannot be resolved, or if we decide to discontinue the service. If we terminate your account without cause, we will refund any prepaid subscription fees on a pro-rata basis.

15. General

15.1 Governing law

These Terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15.2 Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of Dartmouth Live.

15.3 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

15.4 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
